MANDATORY NOTICE: THIS DISCLAIMER CONSTITUTES A LEGALLY BINDING AGREEMENT BETWEEN YOU AND ELCARO INC., A DELAWARE CORPORATION ("ELCARO," "WE," "US," OR "OUR"). BY ACCESSING, DOWNLOADING, INSTALLING, SUBSCRIBING TO, OR USING ANY ELCARO PLATFORM, APPLICATION, TELEGRAM BOT, CHANNEL, WEBSITE, VIDEO, POST, OR ANY OTHER CONTENT OR SERVICE (COLLECTIVELY, THE "SERVICES"), YOU REPRESENT THAT YOU ARE AT LEAST 18 YEARS OF AGE AND AGREE TO BE LEGALLY BOUND BY THIS DISCLAIMER IN ITS ENTIRETY. IF YOU DO NOT AGREE WITH THESE TERMS, YOU MUST IMMEDIATELY CEASE USING THE SERVICES.

Any other regulated financial services entity in any jurisdiction

No fiduciary duty, advisory relationship, or professional-client relationship is created between ELCARO and any user by virtue of accessing or using the Services.

User Representations

By using the Services, you represent and warrant that:

3.1 You are at least 18 years of age (or the age of majority in your jurisdiction, whichever is greater).

3.2 You access the Services voluntarily and of your own free will.

3.3 You are capable of evaluating the merits and risks of financial decisions independently.

3.4 You do not rely on ELCARO for any financial, investment, or trading decisions.

3.5 You understand that any financial decisions you make are entirely your own responsibility.

3.6 You have consulted, or will consult, with qualified financial professionals before making investment decisions.

3.7 You have sufficient financial resources and risk tolerance for any trading activities you undertake, and you can afford to lose the entirety of any capital you put at risk.

4.2 Cryptocurrency-Specific Risks: Cryptocurrency markets are especially volatile, operate 24/7, are largely unregulated, and may be subject to manipulation, flash crashes, exchange failures, smart contract vulnerabilities, regulatory changes, and complete loss of value.

4.3 Algorithmic Limitations: No algorithm, mathematical model, or statistical method can predict market movements with certainty. Past performance of any algorithm, model, or strategy is not indicative of future results.

4.4 Leverage Risk: Trading with leverage or margin can amplify both gains and losses, potentially resulting in losses exceeding your initial investment. Cross-margin and isolated-margin strategies carry additional liquidation risks.

4.5 No Guarantee of Profit: ELCARO makes no representations, warranties, or guarantees that users will achieve any particular financial outcome, profit, or return from using the Services.

No Trading Signals

ELCARO does not provide "trading signals" as commonly understood in the financial industry. Any references to market conditions, price levels, trend directions, support/resistance zones, or timing indicators within ELCARO content represent educational model outputs only and are presented for educational and research purposes. Users must not interpret such references as recommendations to buy, sell, hold, or otherwise transact in any financial instrument.

SECTION 6

No Custody of Funds

ELCARO does not accept, hold, manage, or have access to any user funds, cryptocurrencies, or financial assets. ELCARO will never request transfer of funds to any wallet, account, or payment method not officially listed on elcaro.info. Any such request from any source should be treated as fraudulent.

SECTION 7

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ELCARO INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO: LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, TRADING LOSSES, OR DIMINUTION IN VALUE.

IN NO EVENT SHALL ELCARO'S TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO ELCARO IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100 USD).

Assumption of Risk

By accessing or using the Services, you expressly acknowledge and agree that: (a) the Content is educational only; (b) you assume full and sole responsibility for any and all trading, investment, or financial decisions you make; (c) ELCARO bears no responsibility for any financial outcomes, whether positive or negative, resulting from your use of or reliance on any Content.

Indemnification

You agree to indemnify, defend, and hold harmless ELCARO Inc., its officers, directors, employees, affiliates, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: your use of the Services; any trading or investment decisions you make; your violation of this Disclaimer; or your violation of any applicable law or regulation.

SECTION 10

Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to this Disclaimer or the Services shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules.

THE SERVICES AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, RELIABILITY, NON-INFRINGEMENT, OR UNINTERRUPTED AVAILABILITY.

Geographic Restrictions

The Services are not directed at residents of any jurisdiction where the provision of such services would be contrary to local laws or regulations. Users are solely responsible for determining whether their use of the Services complies with applicable laws in their jurisdiction. ELCARO makes no representation that the Services are appropriate or available for use in any particular jurisdiction.

Amendments

ELCARO reserves the right to modify, update, or replace this Disclaimer at any time, at its sole discretion. Changes become effective immediately upon posting. Your continued use of the Services after any changes constitutes acceptance of the revised Disclaimer. It is your responsibility to review this Disclaimer periodically.

SECTION 14

Severability

If any provision of this Disclaimer is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such finding shall not affect the validity of the remaining provisions, which shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

BY USING ANY ELCARO SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THIS DISCLAIMER IN ITS ENTIRETY. IF YOU DO NOT AGREE, YOU MUST IMMEDIATELY CEASE ALL USE OF THE SERVICES.
